On the part of a medical professional there can be a case of any of these situations: (1) misdiagnosis of an ailment, (2) failure to diagnose a disease, (3) failure to follow a standard or recommended procedure of treatment, (4) error in surgery, (5) failure to obtain the consent of the patient after suitably informing her about the implications of the proposed procedure, (6) inordinate delay in providing the appropriate treatment and, (7) prescribing wrong medication. The patient in such a case might suffer avoidable pain due to injury. In some cases, even death might occur. A medical malpractice law suit would be an obvious consequence.

A simple blood transfusion might result in a person testing positive for H.I.V. and the person affected is entitled in that case to file a medical malpractice law suit against the negligent healthcare professional. In fact, any violation on the part of a medical centre or a medical professional will attract legal action if the victim of that violation chooses to take it as per the prevailing law.

The plaintiff finds any number of companies offering loans for the purpose. Financial dealings with unknown companies not verified for their straightforwardness are always fraught with untold risks, which plaintiffs should be wary of taking.

There can be opportunities for a settlement of a medical malpractice law suit through arbitration between the patient (the plaintiff) and the medical professional (the defendant), and these will definitely be advantageous to both, in many instances, if taken.
